Legal Disclosure, Liability Waiver & Terms of Participation

IMPORTANT: READ THIS DOCUMENT CAREFULLY AND IN ITS ENTIRETY BEFORE REGISTERING FOR, BOOKING, OR PARTICIPATING IN ANY KINGDOM ADVENTURE TOURS EXPERIENCE. BY PROCEEDING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO ALL TERMS CONTAINED HEREIN.

1. Nature of Kingdom Adventure Tours

Kingdom Adventure Tours ("KAT", "we", "us", or "our") is a privately operated adventure travel company founded and operated by Harrison Vaughan. KAT designs, organizes, and facilitates premium, faith-forward group adventure experiences for adult men, domestically and internationally, including but not limited to:

  • Guided motorcycle expeditions in Guatemala and other international destinations
  • Scuba diving expeditions in Roatan, Honduras and other dive destinations
  • Wilderness kayaking and outdoor excursions in Banff, Canada and similar environments
  • Golf and fishing experiences at La Reunión Golf Club and Pacific Ocean locations
  • Volcano hiking, trekking, and summit expeditions including Acatenango and similar peaks
  • ATV and off-road vehicle adventures
  • Camping, wilderness, and spiritual retreat experiences
  • Community outreach and international humanitarian service activities
  • Faith-based devotional programming, group discussion, and spiritual formation activities
  • Travel planning, logistics coordination, and concierge services for international travel

KAT operates as an adventure travel organizer and experience facilitator. KAT is not a licensed tour operator under any specific state or federal regulatory framework unless separately designated. KAT is not a medical provider, licensed counseling service, licensed therapist, licensed psychologist, licensed social worker, licensed minister, ordained clergy body, or accredited academic institution.

2. Assumption of Inherent Risk — Voluntary Adult Participation

ALL ACTIVITIES OFFERED BY KINGDOM ADVENTURE TOURS ARE INHERENTLY RISKY. PARTICIPATION IS ENTIRELY VOLUNTARY. BY REGISTERING FOR OR PARTICIPATING IN ANY KAT EXPERIENCE, EACH ADULT PARTICIPANT EXPRESSLY ACKNOWLEDGES, ACCEPTS, AND ASSUMES ALL RISKS ASSOCIATED THEREWITH.

Adventure activities by their very nature involve risk of injury, serious harm, permanent disability, and death. All participants in KAT experiences are adults acting of their own free will, with full cognitive capacity, and with informed understanding of the risks involved. KAT does not compel participation. Every individual who joins a KAT trip does so as a consenting adult who has independently evaluated the activities and chosen to participate.

2.1 Inherent Risks Include, Without Limitation:

  • Motorcycle operation on varied terrain including paved roads, gravel, mountain passes, and unpaved backcountry routes — including risk of collision, loss of control, mechanical failure, and rider error
  • Scuba diving including decompression sickness, nitrogen narcosis, equipment failure, disorientation, marine animal encounters, drowning, and barotrauma
  • Ocean and deep-sea fishing including vessel capsizing, sea sickness, equipment injuries, and unpredictable weather
  • Volcano and mountain hiking including altitude sickness, falls, rockfall, extreme weather, volcanic activity, and exhaustion
  • ATV and off-road vehicle use including rollover, collision, and loss of control
  • Wilderness camping including wildlife encounters, extreme weather, dehydration, and hypothermia
  • Kayaking and open-water activities including capsizing, drowning, and cold water shock
  • International travel including civil unrest, crime, illness, disease exposure, inadequate medical facilities, and governmental actions
  • Physical exertion beyond normal daily activity levels which may aggravate pre-existing medical conditions
  • Acts of God, natural disasters, and force majeure events

3. Release of Liability and Indemnification

To the fullest extent permitted by applicable law, each participant, by registering for or participating in any KAT experience, hereby releases, waives, discharges, and covenants not to sue Kingdom Adventure Tours, its founder, employees, contractors, guides, local partners, third-party vendors, affiliated ministries, and each of their respective agents, heirs, and assigns (collectively, "Released Parties") from any and all liability, claims, demands, actions, and causes of action arising out of or relating to:

  • Personal injury, bodily harm, illness, disability, or death
  • Loss or damage to personal property
  • Negligent acts or omissions of the Released Parties
  • Inherent risks of the activities described herein
  • Actions of third-party vendors, local guides, or partner organizations
  • Medical emergencies arising during participation
  • Psychological or emotional distress arising from participation in any activity, discussion, or content

Participant further agrees to indemnify and hold harmless the Released Parties from any claims brought by third parties arising out of participant's conduct during any KAT experience.

Note: Some jurisdictions do not permit the exclusion or limitation of liability for certain types of harm. In such jurisdictions, the limitations above apply to the maximum extent permitted by law.

4. International Travel — Risk Disclosure

Kingdom Adventure Tours operates experiences in Guatemala, Honduras, Canada, and other international destinations. Participants acknowledge and accept the following:

4.1 Government Travel Advisories

KAT strongly recommends that all participants review current U.S. Department of State travel advisories (travel.state.gov) for all destination countries prior to booking and departure. KAT is not responsible for changes in political, social, or security conditions after booking.

4.2 KAT's Role in Travel Planning and Logistics

KAT provides itinerary planning, route design, logistical coordination, accommodation selection, guide arrangement, transportation coordination, and concierge-level preparation. This is a facilitation and coordination service only. KAT does not guarantee the performance or safety practices of any third-party vendor, does not act as a licensed travel agency unless separately registered, does not provide legal or immigration advice, and is not responsible for delays or disruptions caused by airlines, vendors, weather, or governmental action.

4.3 Required Travel Insurance

Travel insurance including medical evacuation coverage is MANDATORY for all KAT participants. KAT has partnered with Global Rescue to provide participants access to world-class coverage options including worldwide field rescue, medical evacuation, and 24/7 traveler assistance. KAT is not an agent of Global Rescue and receives no compensation for referrals. Participants who fail to obtain adequate coverage do so at their own sole risk.

4.4 Passport, Visa, and Entry Requirements

Each participant is solely responsible for ensuring they hold a valid passport, required visas, and any other travel documentation required by destination countries. KAT is not responsible for denied entry, deportation, or disruption resulting from inadequate documentation.

5. Faith-Based Content — Spiritual Formation Disclosure

KINGDOM ADVENTURE TOURS IS NOT A LICENSED COUNSELING SERVICE, LICENSED THERAPY PROVIDER, ACCREDITED MENTAL HEALTH PROGRAM, RELIGIOUS INSTITUTION, OR ORDAINED MINISTRY. ANY AND ALL SPIRITUALLY ORIENTED CONTENT, DISCUSSION, REFLECTION, DEVOTIONAL MATERIAL, OR PERSONAL GUIDANCE PROVIDED BY KAT STAFF OR GUIDES IS OFFERED SOLELY AS INFORMAL, NON-PROFESSIONAL PERSONAL PERSPECTIVE. IT DOES NOT CONSTITUTE PROFESSIONAL COUNSELING, CLINICAL THERAPY, PSYCHOLOGICAL TREATMENT, OR FORMAL SPIRITUAL DIRECTION OF ANY KIND.

5.1 Nature of Faith-Based Programming

KAT incorporates faith-forward content into its experiences including morning devotionals, scripture reading, journal prompts, group discussion, testimony sharing, evening reflection, and spiritually framed guidance from trip leaders. This content is personal, experiential, and community-based. It is not licensed psychological counseling, clinical mental health treatment, pastoral counseling from credentialed clergy, certified spiritual direction, medical or psychiatric intervention, or any form of coercive religious programming.

5.2 All Guidance Is Personal Perspective — Not Professional Advice

Harrison Vaughan and KAT staff may offer personal reflections, observations, encouragement, and informal guidance during KAT experiences. Any such guidance, however framed, is the personal perspective of the individual offering it and does not constitute professional advice of any kind — including psychological, therapeutic, medical, legal, financial, or credentialed spiritual advice. Period.

5.3 Participant Spiritual Autonomy

Participation in KAT's faith-based programming is entirely voluntary. No participant is required to engage in devotional content, prayer, scripture reading, or spiritual discussion. KAT does not condition trip participation on any statement of faith. Faith is an invitation, never a requirement.

5.4 Referral to Licensed Professionals

Participants experiencing mental health challenges, emotional crisis, suicidal ideation, substance use concerns, relational trauma, or any other clinical concern are strongly encouraged to seek assistance from licensed mental health professionals before, during, and after their KAT experience. KAT is not equipped, staffed, or positioned to provide clinical intervention of any kind.

6. Physical and Medical Requirements

Participants confirm that they are in adequate physical health to participate in the activities in their chosen itinerary, have consulted a licensed physician if they have any pre-existing condition that may be aggravated by physical exertion or the specific demands of their trip, and will disclose all relevant medical information to KAT prior to departure. KAT guides are not medical professionals and cannot provide medical diagnosis or treatment beyond basic first aid.

6.1 Scuba Diving — Medical Fitness

All dive participants must hold current certifications appropriate to the dives undertaken and must complete a PADI Medical Statement prior to diving. Participants with flagged conditions must obtain physician clearance. KAT and partnering dive operators reserve the right to exclude any participant from diving if participation poses an unacceptable risk in the professional judgment of the dive leader.

6.2 Motorcycle Riding — Licensing and Experience

All motorcycle riders must hold a valid motorcycle license or endorsement from their country or state of residence. Riders must honestly represent their experience level. KAT reserves the right to reassign a rider to the support vehicle if their skill level presents a safety concern in the professional judgment of guides.

7. Participant Conduct and Group Standards

  • Conduct themselves with respect, humility, and integrity toward all participants, guides, local community members, and vendors at all times
  • Follow all guide instructions regarding safety, itinerary, and conduct
  • Refrain from conduct that endangers themselves or others
  • Comply with all applicable laws of destination countries
  • Refrain from use of illegal substances during KAT experiences
  • Engage with community outreach activities with cultural sensitivity and respect

KAT reserves the right to remove any participant from an experience at any time, without refund, if their conduct violates group standards, creates safety concerns, or disrupts the experience of other participants.

8. Community Outreach and Humanitarian Activities

Many KAT experiences include voluntary community outreach in partnership with local ministries. Participants acknowledge that outreach activities are voluntary, KAT does not guarantee outcomes of any outreach activity, and KAT partners with local organizations in good faith but cannot guarantee those organizations' practices or standards.

9. Third-Party Vendors and Local Partners

KAT coordinates with third-party vendors including hotels, motorcycle rental companies, dive operators, transport providers, local guides, and ministry partners. KAT makes commercially reasonable efforts to vet these partners. However, KAT does not own or control any third-party vendor and is not liable for their acts, omissions, or negligence. Participants may be required to sign additional waivers with third-party vendors prior to participation in vendor-led activities.

10. Cancellation, Refunds, and Trip Modifications

Cancellation and refund policies are governed by the specific terms provided at the time of booking through KAT's booking platform. KAT reserves the right to cancel or modify any trip for safety, insufficient enrollment, force majeure, or circumstances beyond KAT's reasonable control. KAT's liability in the event of cancellation is limited to the amount paid for the specific trip. Reasonable itinerary modifications for safety or logistical reasons do not entitle participants to a refund.

11. Photography, Video, and Likeness

By participating in a KAT experience, participants grant Kingdom Adventure Tours a non-exclusive, royalty-free license to use photographs, videos, and other media captured during KAT experiences for promotional and marketing purposes including website, social media, and marketing materials. Participants who do not wish to be photographed should notify KAT in writing prior to departure.

12. Governing Law and Dispute Resolution

These terms shall be governed by the laws of the State of Georgia, United States of America. Any unresolved dispute shall be submitted to binding arbitration in Fulton County, Georgia, under the rules of the American Arbitration Association. Participant waives the right to participate in any class action lawsuit or class-wide arbitration against KAT.

13. Severability

If any provision of this document is found invalid or unenforceable, the remaining provisions continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

This document, together with any trip-specific booking terms provided at registration, constitutes the entire agreement between participant and Kingdom Adventure Tours regarding the subject matter herein and supersedes all prior representations and agreements. No oral representations shall modify the terms of this document.

15. Acknowledgment of Independent Review

KAT strongly recommends that each participant review this document with an independent legal advisor prior to signing or submitting any registration. Participation in any KAT experience constitutes acknowledgment that the participant has had the opportunity to seek independent legal review and has chosen to proceed.
